WHEN A RACE BECOMES A FELONY
Virginia law treats racing on public roads as a form of reckless driving that shows willful disregard for public safety (Va. Code § 46.2-865). To prove it, prosecutors look at circumstances like the time of day, road conditions, the presence of others, and whether the driving showed an intent to race rather than ordinary carelessness. A basic charge is a Class 1 misdemeanor — up to a year in jail and a $2,500 fine.
But the charge escalates fast. If the racing causes injury through willful and wanton conduct, it becomes a Class 6 felony carrying up to five years in prison; if it results in death, the exposure jumps to one to twenty years. On top of that, a conviction typically brings a license suspension of six months to two years, and for a prearranged race, Virginia can even seize the vehicle involved. With that much on the line, an experienced defense that tests the evidence of “racing” is essential.
STREET RACING CHARGES: WHAT TO KNOW
What counts as street racing in Virginia?
Racing a vehicle on a public highway or road (Va. Code § 46.2-865). Courts weigh factors like time of day, conditions, and whether the driving showed intent to race — the key line between racing and ordinary reckless driving.
What are the penalties?
A base charge is a Class 1 misdemeanor (up to 12 months in jail, $2,500 fine). Causing injury through willful and wanton conduct makes it a Class 6 felony (up to 5 years); causing death carries 1 to 20 years.
Will I lose my license?
Usually. A conviction typically brings a license suspension of six months to two years, on top of any DMV point consequences.
Can my car be taken?
For a prearranged race, Virginia allows the vehicle to be confiscated — an added financial hit beyond fines and fees.
What defenses are there?
Challenging whether the evidence actually shows racing (versus reckless driving or ordinary speeding), the reliability of witness accounts, and the circumstances the state is relying on. We look for every opening to reduce or dismiss.
